Revised Crypto Clarity Act Adds New DeFi and Regulatory Changes
Senate Republicans published a revised 630-page t version of the Crypto Clarity Act after negotiations continued during the August recess. The legislation seeks to establish a federal framework for digital asset markets. It also defines how the Securities and Exchange Commission and Commodity Futures Trading Commission would divide regulatory authority.
The updated Crypto Clarity Act introduces changes affecting decentralized finance protocols that remain under human control. Under the proposal, the CFTC and Treasury Department would develop rules for those trading platforms. However, the DeFi provisions now apply only to spot and cash digital commodity transactions.
The revision also clarifies how credit unions may participate in digital asset activities. In addition, Senator Cynthia Lummis stated that the bill includes more than 100 provisions requested by Democrats. However, the legislation still keeps its existing ethics framework with only limited adjustments.
Support Remains Uncertain Before Senate Vote
The Crypto Clarity Act still faces significant political challenges despite the latest revisions. Republicans hold 53 Senate seats, while advancing the bill requires at least 60 votes. Therefore, the party needs support from at least seven Democrats or independents.
Reports indicate that no Senate Democrats currently support the revised draft. The bill also continues to face disagreements over ethics rules, anti-money laundering language, stablecoin yield provisions, and concerns about possible bank deposit outflows. Those issues have delayed broader agreement for months.
A cloture motion will become eligible for a Senate vote on September 15. If senators approve that motion, lawmakers can formally begin debating the legislation. Otherwise, the proposal could face another delay despite recent revisions.
Crypto Clarity Act Builds on Long Push for Market Structure Rules
The Crypto Clarity Act represents one of the most significant efforts to establish federal rules for the U.S. digital asset industry. The measure would define which digital assets fall under SEC oversight and which qualify for CFTC supervision. That distinction has remained one of the industry’s largest regulatory uncertainties.
Lawmakers postponed consideration of the legislation before the August recess to allow additional negotiations. During that period, Republican lawmakers revised several sections to address concerns raised by stakeholders. They also narrowed the DeFi provisions after concerns emerged about possible effects on prediction markets.
Even if the Crypto Clarity Act does not advance next week, regulatory activity is expected to continue. Both the SEC and CFTC have indicated they plan to develop additional market structure rules. Meanwhile, the approaching November midterm elections leave lawmakers with a shorter window to pass comprehensive digital asset legislation this year.
